Uber reports 3,000 sexual assault claims last year in its safety review

In this March 15, 2017 file photo, a sign marks a pick-up point for the Uber car service at LaGuardia Airport in New York.Seth Wenig / Associated Press Uber found more than 3,000 allegations of sexual assaults involving drivers or passengers on its platform in the U.S. last year, part of an extensive and long-awaited review in response to public safety concerns. The ride-hailing company released an 84-page safety report Thursday, seeking to quantify the misconduct and deaths that occur on its system and argue that its service is safer than alternatives.U.S. customers took about 1.3 billion trips last year, Uber said. About 50 people have died in Uber collisions annually for the past two years, at a rate about half the national average for automotive fatalities, according to the company. Nine people were killed in physical assaults last year, Uber said.Uber drivers reported nearly as many allegations of sexual assault as passengers, who made 56 per cent of the claims. There is little comparable data on assaults in taxis or other transportation systems, and experts have said the attacks are widely under-reported. The assault claims reported to Uber ranged from unwanted kissing to forcible penetration. Uber is very much a reflection of society, said Tony West, Ubers chief legal officer who helped spearhead the two-year research effort. The sad, unfortunate fact is that sexual violence is more prevalent in our society than people think. People dont like to talk about this issue.Uber had committed more than a year ago to release a safety study, a promise Lyft Inc. made soon after. Lyft, the second-biggest ride-hailing provider in the U.S., has yet to publish a report. On Thursday, Uber said it would regularly share data with Lyft and other companies about drivers accused of serious safety lapses and continue publishing safety reports every two years.Uber has faced a steady stream of complaints in court across the country over driver misconduct, and Lyft has recently seen an explosion in legal claims by passengers. Just in California, at least 52 riders have sued Lyft this year over allegations they were assaulted or harassed by their drivers, according to filings reviewed by Bloomberg.Uber has faced similar complaints in countries beyond the U.S. The company was sued in 2017 by a woman who alleged top executives violated her privacy after one of its drivers in India allegedly raped her.Regulators in London cited uncertainty about Ubers ability to ensure the well-being of its passengers as a reason they revoked the companys license to operate there last week. Uber will be able to continue operating in the U.K. capital as it appeals the decision. Dara Khosrowshahi, the chief executive officer, said at an event earlier this week that a precursor to trust is transparency.According to the study, the proportion of assaults to total trips decreased by 16 per cent last year as Uber implemented new safety tools, such as contacting drivers and customers when the system identifies unusual activity, as well as adding a button to dial 9-1-1 from the app. I do think Uber is one of the safest ways to get from point A to point B, said West.Uber disclosed five categories of sexual assault allegations. In 2018, Uber received 1,560 reports of non-consensual touching of a sexual body part, 594 reports of non-consensual kissing of a non-sexual body part, 376 reports of non-consensual kissing of a sexual body part, 280 reports of attempted non-consensual sexual penetration and 235 reports of non-consensual sexual penetration. The extent of sexual misconduct, while staggering, isnt unique to Uber, said Ebony Tucker, executive director at Raliance, an advocacy and consulting firm focused on preventing sexual violence. Ubers findings didnt surprise any of us, she said. Sexual assault is pervasive. Its everywhere.Counting assaults is a complicated exercise. Only about a third of claims the company received about penetration without consent were reported to the police, Uber estimated. In about a quarter of cases, Uber said its team didnt successfully communicate with the victim after the initial report. Women reported 89 per cent of the rape allegations, the company said.Uber opted not to disclose many other troubling forms of sexual misconduct that it had previously identified as possible reporting categories. For instance, the company didnt say how many times drivers and riders made inappropriate comments to one another, nor did it disclose incidents of indecent

VW says no base to claims it wants a stake in Tesla

Herbert Diess, CEO of German car giant Volkswagen (VW), attends the companys annual general meeting on May 14, 2019 in Berlin.John MacDougall / Getty Volkswagen is denying reports that its CEO, Herbert Diess, is looking to acquire a stake in electric carmaker Tesla.German business publication Manager Magazin said August 22 that Diess would go in right away if he could on an investment in Tesla, quoting inside info relayed to its reporters via a high-level VW manager. But VW spokespeople told Reuters that the speculation about buying a stake in Tesla made by Manager Magazin is without merit. The magazines report suggested Diess was most interested in the California companys software developers, but that the families that own most of VW, the Piechs and Porsches, likely wouldnt approve of any sort of investment; and that buying Tesla outright for US$30 billion simply wasnt

Lawsuit claims older Tesla’s battery capacities are being artificially lowered

You wouldnt know by looking at it, but this Tesla Model S P80D can drive itself A lawsuit recently filed by the owner of a Tesla Model S alleges the California EV manufacturer is artificially limiting the capacity of older Tesla models so it would avoid having to replace defective batteries, Reuters reports.Under the guise of safety and increasing the longevity of the batteries of the Class Vehicles, Tesla fraudulently manipulated its software with the intent to avoid its duties and legal obligations to customers to fix, repair, or replace the batteries of the Class Vehicles, all of which Tesla knew were defective, yet failed to inform its customers of the defects, the lawsuit alleges. It goes on to say that potentially thousands of owners of older Tesla models have had their battery driving ranges lowered by as many as 64 kilometres following a recent over-the-air software update. Plaintiff David Rasmussens 2014 Model S 85 says his battery capacity fell by about 8 kWh, but that he was told by Tesla the degradation was normal. Other owners have said their cars no longer charge to 100 per cent. The automakers defense notes the software update was made after a Model S caught fire in Hong Kong; the incident prompted Tesla to revise its charging and thermal management settings to help further protect the battery and improve battery longevity. The lawsuit counters that Tesla chose to go behind the backs of its customers and use software updates and throttling of the battery to avoid liability in the wake of these vehicle fires involving the overcharging of lithium batteries.Owners have also alleged the reduction in battery capacity has lowered the value of their

Lawsuit claims GM trucks don’t run properly on American diesel

2015 Chevrolet Silverado HD General Motors line of diesel-powered heavy duty trucks are billed as workhorses, able to haul tens of thousands of pounds with impunity. Endless wells of hairy-chested torque from a 6.6-litre Duramax gets things rolling in a hurry. However, a class action lawsuit filed this week in Detroit seeks to put the brakes on certain models of GMs heavy-hauler, reports the Detroit News.Plaintiffs allege problems with the powertrains high-pressure fuel pumps, units manufactured by Bosch and installed in Duramax-equipped trucks from the 2011 to 2016 model years. According to the suit, the pump introduced metal shavings into the fuel injection system, leading to catastrophic and expensive damage.GM and Bosch declined to offer the Detroit News comment. At the root of this issue, say the complainants, is the composition of American diesel fuel. They claim it to be thinner than European diesel, a trait that allows for less lubrication and eventual degradation of the Bosch pumps. Plaintiffs in the suit say once this happens, debris finds its way into the engine.Lets examine this claim. As we all learned in Gearhead 101, modern diesel fuel is ignited under compression without a spark. A key indicator of diesel fuel quality is its cetane number, a measure of the fuels ignition speed that is, how long it takes to go bang! under compression. A higher cetane number indicates the fuel ignites more readily when sprayed into hot compressed air, such as the environs of an engine cylinder.Generally, diesel in Europe has a cetane rating of approximately 51, while the stuff on this side of the pond is generally rated around 45, except for a few areas in which a minimum of 48 is mandated (not to mention California, whose diesel fuel has a cetane rating of 53).For about the last ten years, all the American highway diesel fuel has been classified as Ultra-Low Sulphur Diesel (ULSD), a blend which lowered the measured sulphur content to less than 15ppm. This, the suit claims, is the root of the problem. The fuel pump used in the trucks in question, a Bosch CP4, was introduced in 2011. Plaintiffs claim it was designed for the European market and didnt play well when swilling American ULSD. This may be so, but it would behoove the smart lawyer to also note that the Duramax engines in question are not fitted with a lift pump. This is a bit of tech that takes some of the workload off the main pump the Bosch CP4, in this case.Without a lift pump, a low-pressure unit which pulls the fuel first, the CP4 is under constant suction and tasked with two jobs, drawing fuel and pressurizing it. This situation may introduce air bubbles into the mix since the pump is located waaaay up in the engine bay, a long distance from the fuel tank. The presence of air means the absence of liquid, and could help explain the production of metal shavings, which are claimed to be causing the expensive damage mentioned in this lawsuit.Regardless of the reason for the fuel pumps alleged degradation diesel quality or being overworked well be keeping an eye on this case as it works its way through the

Tesla scrutinized by U.S. agency over Model 3 safety claims

The Tesla Model 3 PerformanceHandout / Tesla The U.S. National Highway Traffic Administration sent Teslas Elon Musk a cease-and-desist letter last year regarding Model 3 safety claims and has subpoenaed the carmaker for information on several crashes, according to documents posted by a nonprofit advocacy group.NHTSA lawyers took issue with an October 7 Tesla blog post that said the Model 3 had achieved the lowest probability of injury of any vehicle the agency ever tested, the documents released Tuesday by the legal transparency group Plainsite show. The regulator said the claims were inconsistent with its advertising guidelines regarding crash ratings and that it would ask the Federal Trade Commission to investigate whether the statements were unfair or deceptive acts. The documents, obtained through a Freedom of Information Act request, also include orders for information that NHTSA sent to Tesla following several crashes, including a fatal March 1 crash involving a Model 3 operating on Autopilot.Representatives for Tesla and NHTSA didnt immediately respond to requests for comment. A spokeswoman for the FTC declined to comment.NHTSA issued a statement in October that took exception with Teslas characterization of the agencys safety ratings. The agency said its crash tests combine into an overall safety rating and that it doesnt rank vehicles that score the same ratings. NHTSAs guidelines for the use of its test results in advertising warn that using terms such as safest and perfect to describe a particular rating or an overall score are misleading. NHTSA issued a similar statement in 2013, when Tesla said that its Model S achieved a vehicle safety score equated to 5.4 stars. The agency said then that it doesnt rate vehicles beyond 5 stars. This is not the first time that Tesla has disregarded the guidelines in a manner that may lead to consumer confusion and give Tesla an unfair market advantage, Jonathan Morrison, chief counsel at NHTSA, wrote in an October 17 letter addressed to Musk.Al Prescott, Teslas deputy general counsel, wrote in a reply letter that the company respectfully disagreed with NHTSA.Tesla has provided consumers with fair and objective information to compare the relative safety of vehicles having 5-star overall ratings, Prescott wrote in an Oct. 31

Ford sold transmissions it knew were faulty, claims report

2016 Ford Fiesta SE Ford allegedly pressed on with the development and manufacture of its six-speed PowerShift automatic despite internal complaints and a cavalcade of repair issues, according to a new investigative report from the Detroit Free Press. The newspaper mid-July published a lengthy feature on its exploration of transmission problems experienced by owners of Ford Fiesta and Focus small cars.According to the report, problems with the transmission also called the DPS6 reared their ugly heads in testing, well before finding their way into the hands of unsuspecting customers. The PowerShift is a dual-clutch transmission that utilizes parts resembling a manual gearbox but is operated by the driver like a traditional automatic. Lighter than their conventional slushbox counterparts, they were intended to reduce weight and provide fuel economy advantages. They certainly achieved those goals, but it was apparently at the expense of smooth and reliable operation. Using a dry-clutch system, unlike modern dual-clutch units which use a wet-clutch system that bath the clutches in oil, the transmission quickly became notable for jerky shifts and the propensity to slip out of gear, even at highway speeds. Internally, this was apparently called an Unintended Neutral. The Freep reports:“As years wore on, Ford would make the case in emails, internal documents and an affidavit that if the steering, turn signals and other power worked in the car, then the situation couldn’t be considered dangerous. In theory, people could turn on a blinker and steer to the side of the highway if the car slipped into neutral at 70 mph.”Yikes. As costs and complaints piled up, Ford kept trying to find a fix while creating talking points for the poor souls unlucky enough to be in customer-facing positions and bearing the brunt of their complaints.Ford told the Detroit Free Press in a statement that conversations during development about challenges common to innovative new technology were normal exchanges. After the new transmission was on the road, other problems developed. We acted quickly and determinedly to investigate the problems, said the statement. While we eventually resolved the quality issues, the solutions were more complex and took longer than we expected. We regret the inconvenience and frustration that caused some consumers. Heres the kicker apparently, none of this was a total surprise to those on the dev teams. Six months before the 2012 Focus began shipping to dealers, a product development engineer expressed We also cannot achieve a driveable calibration that will get us to production, he wrote in an email to colleagues. The clutch torque delivery MUST BE IMPROVED.When a veteran engineer uses all caps in an email, you know theyre serious.Yet the company pressed on, producing cars equipped with a transmission that has been the catalyst for class-action lawsuits and countless hours of repair work. For many owners, there is still no resolution. Head over to The Freep for its entire

GM claims acceleration victory over Ram in HD pickup wars

In the never-ending Detroit pickup truck wars, it was inevitable that competition between brands would eventually spill over into areas other than simple output numbers.Ram was the first to crest the 1000 lb.-ft. of torque figure, leaving the other two Detroit truck makers to needle them about other matters of supremacy. The latest? Acceleration times. At a presentation last week during media drives of the 2020 Chevrolet Silverado HD, company spox boasted of their trucks ability to take full advantage of torque, claiming their truck is capable of faster acceleration times than an equivalent Ram HD pickup. For the record, GM was showing stats for a Silverado 3500 DRW and a Ram 3500 DRW.According to data shown at the event, Chevys workhorse can whip from zero to 60 mph (96 km/h) in 7.4 seconds, a full two seconds faster than the Ram. When laden with an 18,000-lb trailer, the Chevy can allegedly turn the same trick in 19.9 seconds, a 2.6-tick advantage over the Ram.Executing a highway passing maneuver from 40 to 60 mph with this load in tow is said to take 11.8 seconds in the Chevy, 12.8 in the Ram.Naturally, it didnt take long for Ram to hit back. According to reports, FCA reps were eager to explain theyre more concerned about the ability to maintain speed on a grade rather than flat-out straight-line performance on a billiard-smooth surface.GMs diesel does have 45 horsepower on the Ram, which explains some of its extra urgency in a quick-start situation. Remember the racers creed: horsepower is how fast your car hits the wall, torque is how far you move the wall.In any event, both the Ram and Chevy are within a hairs breadth of each other in terms of maximum towing prowesstheyll pull 35,100 lbs and 35,500 lbs, respectively.Another poke-in-the-eye that GM tossed out to its competition during last weeks launch? They claim that every 3500 DRW diesel can haul at least 30,000 lbs while pointedly asserting the Other Guys cannot make that statement. The truck wars arent ending anytime soon,

‘Aladdin’ star sues Tesla after he claims wheel flew off car

Mena Massouds Tesla Model 3, following a wreck September 2018TMZ It would seem Aladdin has more on his mind lately than foiling the villainous Jafar. According to a report from TMZ, star actor Mena Massoud is instead busy taking legal action against Tesla, claiming the car company is at fault for a crash last year. The entertainment website reports that Massoud alleges the right-front wheel of his then-new Tesla Model 3 suddenly “crumpled” and flew off the car. This, he says, caused him to lose control and hammer the formerly useful electric sedan into a particularly stout tree along the edge of Hollywood Boulevard. Pictures posted by TMZ show a wrecked Model 3 crumpled up like a discarded chip bag, and a destroyed wheel tire assembly. Now, unless our eyes deceive us, that assembly includes a brake caliper and various front suspension parts, all of which are rare to just shear off a car without warning. Keyboard warriors are quick to lay blame in both directions, with some spouting their belief Teslas are poorly made and others thinking there’s no way a wheel and tire combination spontaneously abandons the car onto which it was bolted. At this point, it would appear that it’s up to the courts to figure that one out. There is no mention if Autopilot was engaged. The lawyer cited by TMZ as representing Massoud, Kevin K. Javidzad, is listed as working for the offices of Colony Law in Los Angeles. His practice focuses on, among other things, personal injury matters. For its part, Tesla has been cranking up production of its volume model in the months since Massoud bought his car in September. With the new Model Y scheduled to roll off assembly lines and the flagship Model S sedan due for an interior restyle, Tesla has its hands quite full. (Image from
